When you purchase an item from this website, you are in effect indicating agreement to our terms and conditions (as always your statuary rights are not affected). Please ensure that you read the terms carefully and print a copy for your records. We reserve the right to revise our terms and conditions at any time without prior notice. It is your responsibility to review, and reprint them for your records as required.

The contract undertaken in purchasing products from this website are governed by English Law, and as such any and all disputes which may arise from, or in relation to the above stated contract is subject to but non-exclusive to the jurisdiction of the relevant courts of England and Wales.

 

personal details

In purchasing from this site you undertake to provide, complete and correct information, as well as to inform us that the earliest possible convenience of any change to the information you provide. Should you wish that your information is not retained on our customer database it is your responsibility to inform us as such in writing of such.

Should you choose to make payment via credit card, you undertake to provide the correct personal details as held with your credit card issuer. Should you fail to do so order processing will be delayed until the correct information is supplied.

Where shipping is applicable it is your responsibility to ensure that the correct postal code is entered into both the billing and shipping address to allow the system to supply you with the necessary option relating to the delivery of your purchases based on the information provided.

As per standard good practice you need to ensure all account details and passwords are kept confidential, you are responsible for any and all activity that may occur on your account on this site. Should you suspect any information may be known to someone else or is being misused, it’s your responsibly to notify us immediately and for you take the necessary steps to secure your password.

The site administrator retains the right to edit or remove content on the site, refuse access or cancel an order at our discretion. Should an order be cancelled, we undertake to notify you immediately and you will not incur any costs for this.

 

product availability, pricing & purchasing

The full price of items is stated at the time orders are placed and confirmed. All prices are listed in pounds sterling and include all relevant UK taxes where applicable. Any and all customs charges, import duties and relevant import taxes applied by the relevant country when the items purchased are dispatched to the supplied delivery address are the responsibility of the purchaser.

Following the placement of your order you will receive an email confirming receipt of your order. This however is not a confirmation of the acceptance of the order; acceptance of your order and completion of the contract between ourselves (you the purchases and Intelligent Horsecare the seller) will only take place upon dispatch of the products ordered to the address provide by yourself unless you are notified that we are unable to accept your order or you have chosen to cancel your purchase prior to dispatch.

We aim to ensure all prices listed on the site are correct, however we are only human and errors can occur. If we find that an item you have ordered is incorrectly priced we will inform you as such as soon as possible so that you can reconfirm the order at a correct price or chose to cancel the item. Should we be unable to reach you we will cancel that item in your order and inform you thusly, if you elect to cancel the purchase of the item and you have already paid for it you will be refunded the value of the item cancelled in fill. Likewise should the associated taxes relevant to an item have altered or not been included in the price listed on the site, you will be informed at the earliest convenience prior to dispatch of the item to ensure you still wish to purchase the item at the updated price.

We retain the right to decline or terminate an order for any item that has been incorrectly priced through typo, pricing error from a supplier, or had the incorrect tax or duties applied when our purchase listed. In the event you may have already paid for the item in full we will insure that a full refund of the amount paid and the associated shipping fees is issued at our earliest convenience.

It is important to note that our website is not stock controlled, the items and services listed for sale on this site are offered subject to availability and are sold on a strictly “first come-first serve” basis and may be withdrawn from sale at any time. Payment is taken for both in stock and back order items in full prior to dispatch. If an item you have ordered is out of stock, and is not marked as such on the relevant store page of the site, you will be contacted at the earliest possible convenience to be offered the option have the item placed on back order, where possible we will provide you with and estimated date of delivery, subject to availability, or to have the order cancel and if paid for have the value of the item and any shipping fees refunded. We however reserve the right to cancel the order of any out of stock.

All images used on the site are for illustration purposes only and while we aim to be as accurate as possible in representation items may differ slightly from the images shown. Should we be unable to supply an item order for any reason we will am to contact as soon as we are aware of that fact; if the item has been paid for you will be refunded the value of the item in full along with any applicable shipping costs.

We may elect to ship your order either direct from our suppliers or in smaller more manageable smaller packages, this means you may receive your items in several parts, you will not incur any additional shipping fees unless stated and confirmed by yourself prior to the dispatch of out of stock items placed on back order

Intelligent Horsecare cannot be held responsible for compensation of any associated losses you may suffer should we not have available stock of any item ordered.

 

payment of items

Payment in full is required prior to the dispatch of items, we process payment on both in stock and back order items unless an agreement has been reached prior to proceeding with the placement of the order. We most credit and debit cards including Visa Debit, Barclaycard, Maestro, Visa Electron, American Express via the secure transaction processing agent PayPal. We also accept payment via bank transfer either using the PayPal checkout or by arrangement using direct transfer. We also accept cheque payments; you can either select the option to print off the order and send a cheque payment at checkout or contact us directly to arrange for invoicing.

It must be noted that if payment is made cheque, items will only be dispatched once the cheque has been processed and the associated funds have cleared in full.

We will not be held responsible for the security for and of any payment details you elect to email us.

 

dispatch & delivery

We aim to dispatch goods as soon as possible, usually on the same or next day, but certainly where possible within 5 working days of the receipt payment in for any item or order unless we provided notice either home page or store front informing of any delays or an item being marked as out of stock or awaiting stock on the relevant product page of the web store.

Should you require an item urgently please ensure that you contact us via email prior to placing of the order to ensure stock availability and that any additional associated shipping fee can be applied prior to processing of your order ensuring the relevant item will be shipped at the earliest possible convenience. Failure to contact us prior to placing the order will delay the shipping of your item.

 

international orders

We will gladly accept any EU, international and overseas orders. Please be sure to contact us prior placing an order to get a quotation of the available shipping options for the products you wish to purchase. While we may provide you with several shipping options, it is entirely your choice how you wish to ship the items we do however strongly recommend that you always opt for tracked and insured shipping for the full value of the items you wish to purchase. We are not be responsible for any lost or damage incurred in the shipping of any item and it is your responsibility for pay any associated customs, import duties and taxes levied upon any item upon arrival at destination county, we have no control of these charges and cannot give you indication of what they may be.

Should an international, EU or overseas order placed through the site without contacting us for a shipping quotation, we will contact you prior to dispatch with shipping costings. Intelligent Horsecare will not dispatched any overseas, EU or international order prior the full payment of all associated shipping fees.

Please be aware that due to international insurance regulations we will not warranty any items purchased by a customer from any countries outside the UK and EU. Customers outside this trade zone which choose to purchase items do so at their own risk. In addition to the acceptance of the below stated release of liability as given in the terms and conditions, overseas and international customers do unequivocally release Intelligent Horsecare and its persons in full from any and all liability relating to any product, its purchase, dispatch and use and further to any and all warranties associated with said product. Should a customer outside the UK or EU find an item to be faulty or defective the onus is on the customer to contact the manufacturer directly regarding this matter.

 

goods damaged or lost in transit

When you sign for a delivery be sure to check you have received the correct number of parcels you are signing for. Make not of any damage that appears to have occurred to the parcels on the consignment sheet. Be sure to unpack your deliver immediately and check that items, make sure that the items enclosed match the dispatch note and that the dispatch note matches your invoice. You need to inform us of any errors, faults, damage or goods incorrectly sent within three workings days of receipt of your parcels. Be sure to quote the invoice and order numbers and the date the order was placed in your correspondence.

We do not accept liability for any goods lost in transit unless we are notified witnin 5 workings day s from the expected delivery date, this date is taken to be 3-5 working days from the advised date of dispatch for all standard deliveries and 2- working days from dispatch for expedited deliveries.

 

sample, fitting & trial items

Items sent out for trial are done so at our discretion and at the cost of customer. Those wishing to trail and item need to pay the full value of the item prior to its dispatch.

The trail period is 7 days (including weekends) from the date which you receive the item in question, goods not returned within 5 working days of the trail expiry will be deemed as purchased.

Trial items must be returned in their original packaging in perfect condition. You are responsible for the goods until they are restored to us, and must ensure you take reasonable care of them, returning them to us at your own expense. We strongly recommend that you return the items tracked and insured as you will be liable for the cost of items lost or damage in the post.

If by arrangement you have been sent an item as a sample or for item for sizing you are responsible for ensuring that it remains clean and in its original condition. In regards to horse rugs we strongly recommend that you use a light sheet or a summer rug to keep the lining clean when fitting the rug. While we endeavour to provide the best possible guidance on finding the right size based on our own experience but we cannot be held responsible for rugs that do not fit your horses; the only way to ensure the best possible fit of a rug for your horses is to have a bespoke rug made to your horse’s exact measurements and even then it will only fit based on your horse’s measurements taken at that time.

Do not remove any protective strips or covers. If the item is returned soiled i.e. marked or with hair inside the lining the item will be deemed to have been used and therefore purchased and it will be dispatched to yourself.

 

returns – incorrect sizes ordered / exchanges / or you just change your mind

Should you be in any way unsatisfied with a product you have ordered we offer you a 7 days full money back or exchange on all items, subject to them being returned to unused, unsoiled, undamaged in its original condition in the original packaging with all labels and tags attached. The cost of the returning the times to us falls to you the purchaser. We strongly recommend that you insure your returns to be covered for lost in transit; refunds and exchanges will not be processed until item has been received.

If you order the wrong size, or just change your mind you are welcome to return your goods to us within 7 days from the date which you receive them, for a refund or exchange provided they are in perfect condition and original packaging. You are responsible for the goods until they are restored to us, and must ensure you take reasonable care of them, returning them to us at your own expense. You are responsible for the cost of the return and we strongly recommend that you return the items tracked and insured and obtain proof of postage, as we will not compensate for lost or damaged of returned parcels in transit. If you order an item in the incorrect size, then proceed to use that item it is deemed that you have accepted that item.

If you order an item and proceed to use it and at a later date decide it is the incorrect size/fit you have by using the item accepted that item.

Please note that special orders are not returnable.

Once the order has been safely returned to us they will be inspected, if goods show sign of use, damage or are no long in their original condition, we reserve the right to charge a restocking fee; this is a minimum charge of 25% the value of the time.

Before returning an item, you need to contact us by email to arrange for the return of your goods with 7 days of receiving an item. Do not return an item without prior contact. We do not issue refunds for unauthorised returns made after the 7 days period.

Your refund or exchange will only occur once we have received the original item ordered. You are responsible for the associated cost of postage and insurance for the return of the item to us unless we have sent an item in error, you are entitled to the refund of the cost of returning the item at standard return postage value.

Your original payment will be refunded as soon as possible for the cost of the goods (please note this can take up to 30 days during very busy periods but is normally approx. 7 days). Additionally if you have simply changed your mind and decide you do not want the item, you will not be refunded shipping.

Be aware if you choose to exchange an item you may be billed the shipping fee for the dispatch of the exchange item. We advise you take care and consideration when making selections of options, such as sizing, when purchasing.

 

returns – faulty or damaged goods

If you feel that a product is faulty, has arrived damaged or is missing in parcel, you need to contact us by email us within 7 days of delivery with your concern. Please stop using it immediately and contact us with your concern. If you continue to use the product after discovering a fault, it will be deemed that you have accepted the goods in their damaged condition.

Horse rugs are manufactured to each companies’ standard pattern, unfortunately horses do not come in a standard shape or size. Every horse is unique and like saddles finding the right rug can be challenging, issues associated with fit are not recognised as manufacturer fault and are not covered by manufacturer warranty.

Before returning an item, need to contact us by email with pictures of the fault to receive a return code. Do not return an item without prior contact. You are responsible for the goods until they are restored to us, and must ensure you take reasonable care of them, returning them to us at your own expense. You are responsible for the cost of the return and we strongly recommend that you return the items tracked and insured and obtain proof of postage, as we will not compensate for lost or damaged of returned parcels in transit.

As of 2014 sellers are liable to repay postage on the original purchase if it has been charge and the postage cost of sending the replacement item to the purchaser. They are only liable for the return postage IF it does not state in their terms that the purchaser is liable for the return. As stated above “You are responsible for the cost of the return and we strongly recommend that you return the items tracked and insured and obtain proof of postage, as we will not compensate for lost or damaged of returned parcels in transit.”
We do not issue refunds for unauthorised returns made after the 7 days period. Returns need to be have proof of dispatch within two weeks of issue the return code. If you do not dispatch the item in this time or continue to use the product after this, it will be deemed that you have accepted the goods in their damaged condition.

You are responsible for ensuring the safe returns of the goods to us, make sure the that the item is adequately insured as we are unable to compensate for lost or damaged of items in transit.

If on inspection we find the fault to be a manufacture defect, you will be offered either a replacement item or the refund of the purchase cost of the item as well that standard postage cost if you were charged shipping for the original item. We however reserve the right to seek the opinion of the manufacturer of the goods or another knowledgeable party prior to a decision being made if it is not clear that the goods are faulty or have been damaged due to use or horses being horses. It may take up to 28 days to process your return, but we will do our best to rectify the matter as quickly as possible.

If the goods are found to be perfect and in full working order, or have been damaged as a result of use or horses doing what they do best i.e. horses catching rugs on fences or rugs being stored incorrectly between use, one horse picking on another etc, then the item will be returned to you and you will be liable for any costs we incurred in the assessment of the item as well as the cost of returning the item to you.

For the welfare of our staff and in accordance with the health and safety at work act 1972 all goods must be returned clean and dry. Goods returned as faulty or damaged or used will not be processed unless they are returned to us as such. If goods arrive in an unacceptable state, then you will be liable for the costs to return the item to you for cleaning before any further action can be taken.

 

products – rugs

Please be aware that while we think these rugs are amazing we want to manage expectations as it is still just a rug…!

While we endeavour to provide the best possible guidance on finding the right size based on our own experience but we cannot be held responsible for rugs that do not fit your horses.

Every horse is unique and like saddles the fit of a rug can be challenging, your horse changes body shape over the year and as such what fits your horse at one time may not fit your horse at another. The only way to ensure the best possible fit of a rug for your horses is to have a bespoke rug made to your horse’s exact measurements and even then it will only fit based on your horse’s measurements taken at that time. Issues associated with fit are not covered by manufacturer warranty.

As per welfare recommendations horses should never be left in a rug 24/7, rugs should be removed/changed twice a day.

Waterproof is a relative term. Submarines are 100% waterproof, rugs are not! The extent to which a rug is waterproof will depend on how the fabric is treated; this will also affect breathability. The manufacturer describes this as waterproof, however in extreme enough conditions all rugs will eventually let in water.

While your horse will be cooler than in an insulated rug they will sweat if they exert themselves enough or the temperature and humidity rises sufficiently. In full winter coat on mild days our polar bear princess sometimes perspires lightly just with the enormous effort of grazing! The benefit of the Coolheat is that they will dry as soon as conditions allow and the rug won’t hold moisture next to the skin.

Manufacturer warranties do not cover any damage which may be caused by more than one horse kept in a paddock, catching on fencing, rubbing against doors, damage caused by your horse standing on the rug straps when getting up or any of the other creative ways horses make trouble. This is standard industry practise and unfortunately sometimes our horses are forces for destruction.

Please note that due to the health and safety at work act 1972 rugs need to be returned to us clean and dry. If they arrive in an unacceptable state, then you will be liable for the costs to return the item to yourself for cleaning before any further action can be taken.

 

complimentary feed stuffs

All complimentary feed stuffs available on this site as sold as such and used entirely at your discretion. Intelligent Horsecare cannot be held responsible for any use or misuse thereof. Complimentary feed stuffs are just that, they are not a replacement for correct nutritional management of your horse nor are they a substitute for medical treatment.

It is solely your responsibly to seek the appropriate assistance with regards to health of your horse

 

discounts & vouchers

Discounts are offered entirely at our discretion, are subject to availability and can be withdrawn at any time.

Gift vouchers for the store are available either by contacting us directly or via the website (coming soon). They need to be paid for in full before they are dispatched, and can be dispatched to any location of your choosing within the United Kingdom; international, EU and overseas dispatch can be arranged but we need to be contacted directly as additional dispatch charges will apply.

Vouchers are valid for 12 months from the day of issue and cannot be exchange for monetary value. Vouchers presented after their expiry date will be treated as void.

They can be redeemed either by contacting us directly with a list of the desired items or through the online store using the unique code supplied on the back of the voucher (coming soon). Each voucher must be used in full in single transaction as no change or credit is given for unused portions of a voucher. Only one voucher can be redeemed per transaction. They can be used for full or part payment of any purchase, where they have been used in as part payment; items will be dispatched once the outstanding value of the items is paid for in full. Please make sure you use the full value of each voucher so as not to lose out.

Vouchers cannot be used in conjunction with any other offer (including discounts).

We accept no liability for vouchers lost or stolen. Vouchers cannot be returned or refunded, except in accordance with your legal rights.

We reserve the right to refuse to accept a Voucher which we deem to have been tampered with, duplicated or which otherwise is suspected to be affected from fraud. We reserve the right to change any of these terms and conditions from time to time without notice and to take appropriate action including cancellation of the voucher if, at our discretion, we deem such action necessary.

 

prizes & competitions

These rules are deemed incorporated into each competition except to the extent that any specific instruction in a competition provides otherwise. By entering the competition entrants will be deemed to have read and understood these Terms and be bound by them. All of our decisions will be final and binding.

Any person who is an employee or an immediate family member of an employee, or a person who is directly connected with Intelligent Horsecare is ineligible to participate.  Competitions are only open to residents of the UK and must be 18 years or older unless any other age restriction is specified or implied. Entrants under 18 years of age are required to obtain permission from their parent or guardian in advance of entering any competition.

All entries must be received by the closing date specified in the competition. No responsibility will be taken for any entries that are misdirected, lost for technical or other reasons or received after the closing date. We reserve the absolute right to disqualify any entrant to any competition which we consider has used improper technical means to enter. Entrants are liable for their costs to access computer networks.

Prizes are offered entirely at the discretion of Intelligent Horsecare. If for any reason the stated prize is unavailable we reserve the right at our absolute discretion to substitute a similar prize of equivalent or greater value. Only one prize will be awarded per household. There will be no cash or other alternative to the prize offered and prizes are not transferable.

The winner’s name will be selected following the stated competition closing date. If a prize is offered the winner will be notified by email within 28 days following the selection. Failure to respond to our notification email within 20 days will result in the prize being forfeit. Allow an additional 28 days for receipt of the prize following confirmation of the winner’s delivery address.

If the winner of the a competition is unable to take up a prize for any reason or if the winner cannot be notified after reasonable efforts having been made then we may dispose of the prize as we think fit without any liability to the winner for having done so.

For each competition, only one prize will be awarded per entrant email address. Names of winners will be available on request.

 

testimonials, feedback & reviews

If you submit a review, offer feedback or provide us a testimonial or image, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media.

You grant Intelligent Horsecare the right to use the name that you submit in connection with such content, if we choose. You agree to waive your right to be identified as the author of such content and your right to object to derogatory treatment of such content.

You agree to perform all further acts necessary to perfect any of the above rights granted by you to Intelligent Horsecare, including the execution of deeds and documents, at the request of Intelligent Horsecare. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that, as at the date that the content or material is submitted to Intelligent Horsecare and that the content and material is accurate;

Use of the content and material you supply does not breach any applicable Intelligent Horsecare guidelines and will not cause injury to any person or entity (including that the content or material is not defamatory). You agree to indemnify Intelligent Horsecare for all claims brought by a third party against Intelligent Horsecare arising out of or in connection with a breach of any of these warranties.

 

wholesale

Wholesale accounts are available by arrangement at the discretion of Intelligent Horsecare, we retain the right to update or alter wholesale terms without prior notice. Wholesale accounts operate on a strictly 30 day payment policy, should payment not be forth coming within the stated payment period we reserve the right to return a wholesale account to payment prior to dispatch

The property in the goods shall remain with Intelligent Horsecare, until such time as any outstanding invoices are paid in full, but the risk in the goods passes to the wholesaler on delivery.

If payment of the total price or other sums is not paid on the invoice due date (or 30 days from date of invoice), Intelligent Horsecare has the right with or without prior notice at any time, to retake possession of the whole or any part of the products and for that purpose to go upon any premises occupied by the buyer thereof without prejudice to any other remedy of Intelligent Horsecare.

We reserve the right to incorporate a Credit Charge in our invoice to encourage settlement of terms. Prices are correct at the time of printing, but as prices of Raw Materials are constantly fluctuating, we reserve the right to alter prices without notice.
